Terms of Service.
Please read these terms carefully before using the WildTag platform.
Acceptance of Terms
By accessing or using the WildTag platform ("Platform"), including the website at wildtag.com and any mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use the Platform.
These Terms constitute a legally binding agreement between you and WildTag, Inc. ("WildTag," "we," "us," or "our"). You represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract in your jurisdiction.
Your continued use of the Platform after any modification to these Terms constitutes your acceptance of the modified Terms. We recommend reviewing these Terms periodically.
Accounts & Eligibility
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify WildTag immediately of any unauthorized use of your account.
WildTag reserves the right to refuse service, terminate accounts, or remove or edit content at its sole discretion. Accounts may not be transferred, sold, or used by anyone other than the registered account holder.
Outfitters and guides are subject to additional verification requirements including, but not limited to, license verification, insurance documentation, identity confirmation, and business registration review. Approval is at WildTag's sole discretion.
Bookings & Payments
All bookings made through the Platform are subject to the outfitter's individual listing terms, availability, and cancellation policies as published on the listing at the time of booking.
A non-refundable deposit is required at the time of booking to secure your reservation. The deposit amount is set by the outfitter and displayed on the listing. By completing a booking, you acknowledge and accept the non-refundable nature of the deposit.
Remaining balances are held in escrow by WildTag's payment processor (Stripe Connect) until both parties confirm the trip is complete. Release timing is governed by the outfitter's stated payment schedule as disclosed on the listing.
WildTag charges a platform service fee on each completed booking. This fee is disclosed at checkout before payment is submitted. The fee is non-refundable except in cases of verified outfitter-initiated cancellations.
All payments are processed through Stripe. WildTag does not store card details. By using the payment system, you also agree to Stripe's terms of service and privacy policy.
Outfitter & Guide Obligations
Outfitters and guides who list services on WildTag agree to: (a) maintain all required licenses, permits, insurance, and legal authorizations required in their jurisdiction; (b) provide services materially consistent with the listing description; (c) honor all accepted bookings except in documented cases of force majeure; (d) comply with all applicable federal, state, and local laws including hunting regulations, safety requirements, and guide licensing statutes.
Outfitters and guides are independent contractors, not employees or agents of WildTag. WildTag is not responsible for the conduct of any outfitter or guide, or for the quality, safety, or legality of any trip.
Misrepresentation of credentials, services, or qualifications is grounds for immediate account termination and may be reported to the relevant licensing authorities.
Tax obligations arising from payments received through the Platform are the sole responsibility of the outfitter or guide. WildTag will provide applicable tax documentation (1099-K or similar) as required by law.
Prohibited Use
You agree not to use the Platform for any unlawful purpose or in violation of these Terms. Specifically, you may not: (a) impersonate any person or entity; (b) submit fraudulent or inaccurate information; (c) circumvent or attempt to circumvent the Platform's payment system; (d) engage in off-platform bookings to avoid service fees; (e) post content that is defamatory, harassing, or illegal; (f) interfere with or disrupt the Platform's infrastructure; (g) scrape, crawl, or data-mine the Platform without written permission.
Off-platform booking agreements initiated through WildTag introductions are a violation of these Terms and may result in immediate account termination, forfeiture of earnings, and legal action.
Reviews and ratings must be truthful, first-hand accounts. Fabricated reviews, review trading, or coordinated review manipulation is prohibited and will result in account suspension.
Liability & Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WILDTAG DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WILDTAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Hunting, fishing, and outdoor activities involve inherent risk of injury or death. WildTag is a technology platform that facilitates bookings and is not an outfitter, guide service, or outdoor adventure company. WildTag assumes no responsibility for the conduct of any trip, the condition of any hunting ground or waterway, or any injuries, losses, or damages arising from participation in any activity booked through the Platform.
WildTag's total cumulative liability to you for all claims arising from or relating to these Terms or your use of the Platform shall not exceed the greater of: (a) the total service fees paid by you to WildTag in the 12 months preceding the claim, or (b) $100 USD.
Disputes & Resolution
In the event of a dispute between a hunter/angler and an outfitter or guide regarding trip performance or payment release, either party may file a formal dispute through the Platform within 7 days of the scheduled trip completion date.
WildTag will review evidence submitted by both parties and may, at its discretion, mediate a resolution including partial or full refund of escrowed funds. WildTag's dispute decisions are final with respect to escrow release.
All disputes between you and WildTag arising out of or relating to these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Travis County, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration against WildTag.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Termination
You may terminate your account at any time by contacting WildTag support or using the account deletion feature in your settings. Termination does not affect any outstanding bookings, obligations, or disputes.
WildTag may suspend or terminate your account at any time, with or without notice, for conduct that WildTag believes: (a) violates these Terms; (b) is harmful to other users, third parties, or WildTag; (c) is fraudulent, deceptive, or illegal.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Changes to These Terms
WildTag reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform with a new "Last Updated" date and, where appropriate, by sending an email notification to registered users.
Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform.
